General Terms and Conditions by RSN-Schweiz GmbH

1. Scope of Application

These General Terms and Conditions ("GTC") shall apply to all deliveries effected and services rendered by RSN-Schweiz GmbH ("RSN-Switzerland") on the basis of orders placed in the Internet Shop. Supplementary or deviating terms and conditions of the customer shall require RSN-Switzerland's explicit written and duly signed acknowledgement in order to be valid.

2. Conclusion of contract

2.1. All offers of RSN-Switzerland shall be non-binding and are to be understood as an invitation to the customer to submit an offer himself. RSN-Switzerland shall be entitled to accept only parts of such orders.

2.2. Placing of an order will only be possible if all obligatory fields of the online order form (marked with an asterisk) have been completed. Prior to submitting the order the customer will receive a summary of the order including prices. The summary can still be corrected by the customer. Receipt of the order by RSN-Switzerland will be acknowledged by an automatically generated e-mail to the e-mail address provided by the customer, which shall, however, not be an acceptance of the order. Messages will only be received by RSN-Switzerland during normal business hours (Monday to Friday from 9 a.m. to 4 p.m. excluding Swiss public holidays). If orders are received after business hours, they shall be deemed received only at the beginning of business hours on the next working day. The customer shall be obliged to ensure the proper acceptance of the goods ordered.

2.3. The contract will be concluded upon acceptance of the order by RSN-Switzerland, i.e. by mailing of an order confirmation via e-mail to the e-mail address provided by the customer. The respective order confirmation will contain an order number, which shall be indicated by the customer when corresponding with RSN-Switzerland.

3. Product description

3.1. The descriptions, technical data and product prices may be changed at any time. The information given at the time of the online order is applicable. We cannot be held responsible for any typographical or graphic errors.

4. Right of revocation

4.1. We grant a voluntary right of revocation. The revocation period is fourteen (14) days. Further information on the right of revocation, on the modalities of the revocation and on exceptions to revocation can be found under the article revocation. In case of revocation the purchase price shall be reimbursed only if the customer returns the goods delivered at the same time. The goods must be in their original packaging, unused and resaleable as new. Returns shall be made to Schenker Schweiz AG, z.Hd. Riedel - Tiroler Glashütte GmbH, Allmendstrasse 5, CH-8422 Pfungen. The cost of returning goods shall be borne by the customer.

4.2. Goods that are impaired by traces of use or otherwise damaged are not subject to revocation. The same applies if accessories are missing upon return of the goods (e.g., original packaging).

5. Prices

5.1. Prices displayed in CHF (Swiss francs) include 7.7% VAT. Packaging and shipping costs: see shipping and delivery information.

6. Delivery and delivery period

6.1. Shipping to the delivery address provided by the customer with the order shall be at the risk and cost of the customer. If address details provided by the customer are incorrect, incomplete or unclear, any costs arising thereof shall be borne by the customer.

6.2. The indication of delivery dates shall be non-binding and is intended for orientation purposes. Should RSN-Switzerland not be able to accept an order – for example due to non-availability of the goods – RSN-Switzerland shall inform the customer immediately. The exact time of delivery will be communicated to the customer upon receipt of the order.

6.3. Any unforeseeable circumstances or circumstances independent of the parties' intent, such as, e.g., all cases of force majeure, pandemics and similar events as well as delays in delivery by sub-suppliers for whatever reasons, shall extend the delivery period by the duration of the impediment.


7. Terms of payment

7.1. The customer shall pay the purchase price including additional costs exclusively with one of the following credit cards: Visa, MasterCard, American Express and PostFinance. The credit card provided will be charged prior to dispatching the order to the delivery address provided by the customer. RSN-Switzerland shall not store the credit card data in any form. RSN-Switzerland uses the SSL encryption mechanism (Secure Socket Layer) when transmitting credit card data. The SSL system can be recognized by the fact that the site address (URL) starts with "https" instead of "http" and a closed lock or key symbol appears in the status bar at the bottom of the screen. For using SSL, the customer does not need any special software; common web browsers in all recent versions should support the SSL protocol.

7.2. Prepayment: You will receive the invoice by e-mail or as a PDF file with the necessary bank details. The order will be executed upon receipt of the payment.

7.3. The ordered goods will only be shipped to the address provided by the customer if the purchase price including additional costs can be debited to the credit card provided by the customer.

8. Warranty and defects

8.1. Transport damages und defects: The customer shall immediately notify the carrier of potential damage or defects. In case of unconditional acceptance, the goods shall be deemed approved. Thereafter, the warranty shall only by valid for hidden defects, i.e. defects that were undetectable during appropriate inspection. Defects that come to light during the warranty period shall be reported in writing as soon as they are discovered, at the latest within seven (7) days.

8.2. The statutory warranty period is two (2) years and commences upon delivery of the goods. RSN-Switzerland reserves the right to provide warranty by equivalent replacement of the goods. If the replacement delivery fails, you have the choice either to rescind the contract or to demand a reduction of the purchase price. Any further or concurrent statutory warranty rights are expressly excluded to the extent permitted by law.

8.3. Damages caused by natural abrasion, aging, improper handling and lack of or incorrect care are excluded from the warranty. The warranty lapses if products are further processed, engraved, decorated or otherwise modified by the customer despite recognizable defects.

8.4. Complaints / revocation: Any possible return or revocation is subject to the provisions of section 4 of the GTC. Beyond this, returns are only possible in the event of defective materials or manufacturing errors. The returned goods must be in perfect condition and in their original packaging. Returns shall be made to Schenker Schweiz AG, z.Hd. Riedel - Tiroler Glashütte GmbH, Allmendstrasse 5, CH-8422 Pfungen. The cost of returning goods shall be borne by the customer.

9. Exclusion of liability

9.1. Liability of RSN-Switzerland for all claims of the customer is limited to acts of unlawful intent or gross negligence, and in any case to the amount of the total purchase price of the delivery. Liability of RSN-Switzerland for indirect or secondary damages, such as loss of profit, interruption of production, as well as reputation damages, liability damages, legal action damages and claims for damages to other goods, etc., is excluded to the extent permitted by law.

9.2. Liability for acts and omissions of associates and auxiliary persons is excluded tot he extent permitted by law.

10. Retention of title

10.1. RSN-Switzerland shall retain title to delivered goods until full payment of the purchase price including all additional costs.

11. Data protection

11.1. The employees of RSN-Switzerland are subject to the confidentiality obligations of the Data Protection Act.

12. Applicable law and jurisdiction

12.1. This contract is subject to Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods.

12.2. The place of jurisdiction is Zug. A Consumer may bring an action either at the registered office of RSN-Switzerland or at his own domicile. RSN-Switzerland may only bring an action against a consumer at his domicile.
